RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2007-03338 INDEX CODE: 107.00 XXXXXXXXXXXXXXXXX COUNSEL: NO HEARING DESIRED: NO ________________________________________________________________ _ APPLICANT REQUESTS THAT: His award of the Global War on Terrorism Service Medal (GWOT-S) and Global War on Terrorism Expeditionary Medal (GWOT-E) be removed from his records and he be awarded the Afghanistan Campaign Medal (ACM) and Iraq Campaign Medal (ICM) in their place. ________________________________________________________________ _ APPLICANT CONTENDS THAT: He was initially informed he could submit for all four awards, the GWOT-S, GWOT-E, ACM, and ICM. Subsequently, he found out that he could only receive the GWOT-S and GWOT-E or the ACM and ICM. He would prefer the latter two. In support of his request, the applicant has provided a personal statement; a letter of support from his vice commander; a letter to the National Personnel Records Center requesting all four awards; his DD Form 214, Certificate of Release or Discharge from Active Duty; DD Form 215, Correction to DD Form 214; two Enlisted Performance Reports; award documents for the Bronze Star Medal (BSM) and Air Medal (AM); and Individual Flight Record Reports. The applicant’s complete submission, with attachments, is at Exhibit A. ________________________________________________________________ _ STATEMENT OF FACTS: On 31 May 2004, the applicant was honorably discharged from the Regular Air Force for sufficient service for retirement and retired effective 1 June 2004 in the grade of chief master sergeant (E-9). He served 27 years, 2 months, and 16 days of active duty of which 3 years, 5 months, and 5 days was foreign service. Subsequent to his retirement, the applicant’s DD Form 214 was corrected to add the BSM, GWOT-S, GWOT-E, and the Air Force Expeditionary Service Ribbon with Gold Border (AFESR w/GB). The remaining relevant facts pertaining to this application, extracted from the applicant’s military records, are contained in the letter prepared by the appropriate office of the Air Force at Exhibit B. ________________________________________________________________ _ AIR FORCE EVALUATION: AFPC/DPSIDR recommends disapproval of the applicant’s request for the ACM and ICM. DPSIDR states the applicant served on active duty from 15 March 1983 through 31 May 2004 and received the GWOT-S and GWOT-E for his support of Operation ENDURING FREEDOM (OEF). He is requesting the ICM and ACM based on sorties he flew; however, they were unable to verify the applicant completed the required amount of sorties to make him eligible for award of the ICM or ACM. DPSIDR states to be eligible for the ACM and ICM, a service member must be assigned or attached to a unit participating in OEF for 30 consecutive days or for 60 nonconsecutive days in Afghanistan. Service members may also be eligible for these awards by participating as a regularly assigned aircrew member flying sorties into, out of, within, or over Afghanistan and Iraq in direct support of OEF. Each day that one or more sorties are flown in accordance with this criteria counts as one day towards the 30 consecutive or 60 nonconsecutive day requirement. The DPSIDR evaluation is at Exhibit C. ________________________________________________________________ _ APPLICANT'S REVIEW OF AIR FORCE EVALUATION: A copy of the Air Force evaluation was forwarded to the applicant on 21 December 2007 for review and response within 30 days (Exhibit D). As of this date, this office has received no response. ________________________________________________________________ _ THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice. After a thorough review of the available records, we found no evidence that the individual is eligible for the award of the ACM or ICM. We note the applicant’s request that he wishes to “trade-in” his GWOT-S and GWOT-E awards in exchange for the ACM and ICM awards; however, “trading” awards is not an option. Additionally, eligibility criteria for the ACM and ICM are different than that of the GWOT-S and GWOT-E. The applicant did not provide any documentary evidence to substantiate that he is eligible for the ACM or ICM or, that he was recommended for these awards. In the absence of such evidence, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt their rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.
